Student Payments Terms and Conditions

1. Applicable Terms and Conditions

1.1 - Leeds Arts University (“the University”) will apply these Terms and Conditions to online payments received. By using this facility, you are deemed to have accepted them and agree to be bound by them.

1.2 - These Terms and Conditions are applicable to the URLs

1.4 - The University will review these Terms and Conditions annually.

1.5 - These Terms and Conditions are effective from 1st September 2023. You are advised to retain a copy of these Terms and Conditions which are valid at the time of acceptance for future reference.

1.7 - The University accepts no liability for any damages whatsoever that arise out of the use, inability to use or the results of using this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

1.8 - Using this website indicates your acceptance of the University’s policy on personal data usage and retention, with regards to using this service. A link to the University’s Data Protection Policy can be found in Section 7.

2. Tuition Fees

2.1 - These Terms and Conditions relate to online payments. Terms and Conditions regarding your offer and enrolment must be read and agreed as part of the enrolment process. 

2.2 - The Tuition Fee and Bursary Policy relating to your year of enrolment must be read before making a payment.

2.3 - The payment of any sums does not in itself indicate the existence of a contract between the University and the student. A contract will only come into being after the University has processed the enrolment/re-enrolment and the student has indicated acceptance of the University Terms and Conditions.

2.4 - Information displayed on the online payment facility in respect of fees due is for guidance only. The definitive amount of fees payable will be available on the University website. You should contact studentfinance@leeds-art.ac.uk before making payment if the you feel that the fee on the online payment facility is incorrect.

2.5 - All payments made through the Flywire WPM online payment facility must be made in Pounds Sterling. A parent or sponsor can set up the instalment plan on Flywire WPM on a students behalf if the student has provided them with their Student ID number and date of birth. The student ID and date of birth must only be provided to parents or sponsors.  This information should not be provided to any other third parties offering to pay fees on your behalf. It is the responsibility of the student to ensure that payments are only made from a legitimate source. If in doubt contact studentfinance@leeds-art.ac.uk to discuss prior to making payment.

2.6 – Payments made in a foreign currency must be made through the Flywire Payment System quoting the student ID Number, by the student or the person declared on the CAS questionnaire as funding your studies. If the payer is not the person declared, additional checks will be performed in advance of the University accepting payments. The University reserves the right to hold the funds in a suspense account and not allocate to the students account until we are satisfied that the payment is from a legitimate source.

2.7 - Where an instalment arrangement is set up to make recurring payments from a credit/debit card, the University will notify the card holder  of the amounts and the dates on which instalments will be claimed.

2.8 - Payment will normally reach the University’s account within 3 to 5 working days.

3. Print Credits

3.1 - All payments made through the online payment facility for print credits must be made in Pounds Sterling.

3.2 – Following payment, the account will normally be updated instantly and the print credits are available to use.

3.3 – Print credits are non-refundable. Credit will remain on your account whilst you are a student at the University, however it is your responsibility to monitor the balance on your account and confirm you have entered the correct amount before purchasing, to ensure that you only purchase the required amount of credit.

4. Payment & Card Security

4.1 – See 2.6 for payments made in a foreign currency and link to the payment system. If the Flywire WPM system for home students is used in error any currency or conversion costs incurred in making or processing the payment shall be borne by the student and will not be deducted from the outstanding balance.

4.2 - Card details are automatically encrypted once entered. The University will have no access to the card number once entered.

4.3 - The University accepts no liability for charges incurred as a result of entering improper details.

4.4 - The University accepts no liability in the event a card payment is declined or refused by the card issuer. Nor is the University under any obligation to bring this fact to your attention in the event of a payment being declined or refused. It is your responsibility to check with your bank/credit/debit card supplier that payment has been deducted from your account.

4.5 - This site is secured by a SSL Certificate which provides secure encrypted communication for all data to and from the site.

4.6 - The storage of card details is Payment Card Industry Data Security Standard (PCI DSS) compliant(https://www.pcisecuritystandards.org/security_standards/index.php).

4.7 - Payments are processed by the University’s Payment Services Provider, Global Pay. Payments will usually reach the University bank account within 3 – 5 days

5. Your Account

5.1 - It is the responsibility of the individual making the payment or setting up the payment planto ensure that all information requested is entered accurately. This includes email addresses for confirmation.

5.2 - You must not enter false information or give personal details of another person or entity that you are not authorised to use.

5.3 - If the University suspects your account has been involved in a fraudulent transaction or involved in misuse of the website or a security breach, it will be suspended without prior notice. This does not affect either party’s statutory rights.

5.4 - By using the online payment facility, you agree that the University may hold your personal details for the purposes stated (see Section 7 Data Protection).

6. Refunds & Cancellations - Online Payments

6.1 - Refunds will only be granted in exceptional circumstances.

6.2 – For tuition fee refunds, refer to The HE Tuition Fee and Bursary Policy appropriate for your year of entry.

6.3 – Print Credits are non-refundable. See section 3.3

6.4 - Refunds will only be made back to the card used in the original transaction. If a refund is requested outside of the card issuers permitted timescale, evidence will be requested regarding the origin of payment before a bank transfer is approved.

6.5 - Processing of refunds may take up to 30 days.

7. Data protection

The University will comply with Data Protection Legislation, which includes the UK General Data Protection Regulation (the UK GDPR), the Data Protection Act 2018 (DPA) and any other legislation and regulatory requirements relating to personal data in force from time to time. We will only use the personal information you supply to us for the purpose it was provided. Personal data will only be shared if there is a legal obligation or legal basis for processing or when you have provided your consent to share.  Please find our Data Protection Policy and Student Data Privacy Notice.

Please ensure you have read and are in agreement with these documents before confirming these Terms and Conditions.

8. Disclaimer

While the University tries to ensure that the information and content on this payment site is accurate at the time it was published on the site, it does not warrant that this is the case. To the fullest extent permitted by law, the material on this website and its online payment facility is provided “as is”, and without warranties, conditions or other terms of any kind.

While the University will make reasonable efforts to ensure that the online-payments system is available and usable at all times, it does not guarantee continuous, uninterrupted or secure access to the system. While every reasonable effort has been made to ensure accessibility, the University does not guarantee that use of the online-payments system will be compatible with all hardware and software of its users. The University reserves the right to suspend or withdraw access, without notice, to either the whole or part of the payment site, for any reason.

Nothing on this payment site constitutes any part of a contract unless otherwise expressly stated.

9. Governing Law

The Contract will be governed by and construed in accordance with English Law. The English Courts will have exclusive jurisdiction to deal with any dispute which may arise out of or in connection with the Contract.
